The All Inclusive Settlement Fee generally includes: initial title and recorded lien search, title insurance binder, administrative costs, preparation of closing documents, wire fees, notary fees, and time expended in clearing title. In a purchase/sales transaction, the party stipulated in the sales contract as the party responsible for purchasing the owner's title insurance policy shall be responsible for $595.00 of the Settlement Fee, and the other party shall be responsible for $400.00 of the Settlement Fee, unless otherwise agreed to in writing by both parties. As of July 1, 2017, The Florida Legislature has passed HB 483/SB 398 to cap the fees that community association management companies can charge for estoppel certificates at $250.00 for unit owners who are current in their assessments, and allows for an additional $100 fee for “expedited” estoppel certificates (delivered within three business days), and another $150 fee for owners who are delinquent in their assessments. This is a maximum of $500.00 for an expedited, delinquent estoppel certificate.
